Terms of Service

These Terms of Service ("Terms") govern your use of PhantomPen, operated by Polsia, Inc. ("we," "our," or "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use PhantomPen.

1. Service Description

PhantomPen is an autonomous LinkedIn content service. We generate LinkedIn posts written in your voice and, with your authorization, publish them to your personal LinkedIn profile via the LinkedIn API.

PhantomPen does not and will never:

• Post comments on other people's LinkedIn content on your behalf
• Send direct messages (DMs) to anyone on LinkedIn
• Send connection requests
• Like, react to, or share other people's posts
• Follow or unfollow accounts
• Access your LinkedIn inbox or notifications

Our LinkedIn API access is scoped to posting to your own profile only. We request only the minimum permissions necessary.

2. Account Registration

You must be 18 years of age or older to use PhantomPen. You agree to provide accurate information when creating your account and to keep your credentials secure. You are responsible for all activity that occurs under your account.

3. LinkedIn Authorization

When you connect your LinkedIn account, you grant PhantomPen permission to publish posts to your LinkedIn profile using the LinkedIn API. You can revoke this authorization at any time by:

• Disconnecting LinkedIn from your PhantomPen settings, or
• Revoking access directly in LinkedIn's settings under "Permitted Services."

You remain responsible for all content published to your LinkedIn profile, including content generated by PhantomPen. You agree not to use PhantomPen to publish content that violates LinkedIn's Terms of Service or Community Policies.

4. Subscription and Pricing

PhantomPen is a paid subscription service. Current pricing is displayed at phantompen.polsia.app.

• Trial period: New accounts receive a 7-day free trial. No credit card required to start.
• Subscription billing: After the trial, your subscription is billed monthly at the rate displayed at signup. Your subscription renews automatically on the same date each month.
• Payment processing: Payments are processed by Stripe. By subscribing, you agree to Stripe's Terms of Service.
• Price changes: We will give at least 30 days' notice of any price increase via email before it takes effect.

5. Cancellation and Refunds

• Cancellation: You may cancel your subscription at any time from your account settings or by emailing phantompen@polsia.app. Cancellation takes effect at the end of the current billing period. You retain access to the service through the end of the period you have paid for.
• Refunds: We offer a full refund within 7 days of your first paid charge if you are not satisfied. After that, we do not offer partial or prorated refunds for unused time. To request a refund, email phantompen@polsia.app.
• Trial cancellation: You may cancel during the trial period at no charge.

6. Acceptable Use

You agree not to use PhantomPen to:

• Publish spam, unsolicited promotions, or deceptive content
• Publish content that is false, misleading, or fraudulent
• Impersonate any person or organization
• Publish content that violates any applicable law or regulation
• Publish content that infringes the intellectual property rights of others
• Publish hate speech, harassment, or content that incites violence
• Attempt to circumvent LinkedIn's Terms of Service or API restrictions
• Resell, sublicense, or otherwise commercialize access to PhantomPen

We reserve the right to suspend or terminate accounts that violate these terms without refund.

7. Content Ownership

You retain ownership of all content published to your LinkedIn profile, including posts generated by PhantomPen. By using PhantomPen, you grant us a limited license to generate, store, and process content on your behalf to provide the service. We do not claim ownership of your content.

We may use anonymized, aggregated data about content performance and usage patterns to improve the service. We will never use your specific posts or personal information to train models for other customers.

8. Service Availability

We aim to provide reliable service but do not guarantee 100% uptime. We are not liable for temporary interruptions due to maintenance, infrastructure issues, or LinkedIn API availability. LinkedIn API access is subject to LinkedIn's own policies and rate limits, which are outside our control.

We reserve the right to modify or discontinue the service with at least 30 days' notice. If we discontinue the service, we will provide a prorated refund for any prepaid period.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• PhantomPen is provided "as is" without warranty of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
• Our total liability to you for any claims arising from these Terms or your use of the service is limited to the amount you paid us in the 3 months preceding the claim.
• We are not responsible for the consequences of content published to your LinkedIn profile, including but not limited to LinkedIn account restrictions, reputational effects, or professional consequences.

10. Indemnification

You agree to indemnify and hold harmless Polsia, Inc. and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third party's rights.

11. Privacy

Your use of PhantomPen is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to Terms

We may update these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after changes are effective constitutes acceptance. If you do not agree to the updated Terms, you must cancel your account before the changes take effect.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Polsia, Inc. regarding PhantomPen. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
